Posting of Apartment Dues Debt Lists and the New 2026 KVKK Decision
Posting of Apartment Dues Debt Lists and the New 2026 KVKK Decision — Financial matters and dues collection in apartment management are the cornerstone of transparency. According to Article 20 of the Condominium Law (KMK), every unit owner is obliged to contribute to common expenses. Enforcement proceedings and legal mortgage rights arise against non-payers.
Legal Basis
Articles 20-22 of the KMK regulate participation in dues and common expenses. A legal mortgage can be placed on the apartment for unpaid dues. With the 2026 amendment, follow-up processes have been accelerated.
Implementation Steps
1. Notice of Default
A 30-day payment notice is sent to the debtor via notary.
2. Enforcement Proceedings
An application is made to the enforcement office with a general assembly resolution.
3. Collection
Collection is carried out through wage garnishment, bank account freezing, or apartment sale.
Attention: A general assembly resolution is required before proceedings. Proceedings not recorded in the decision book are invalid.
Imer Yonetim: All enforcement and collection processes are handled by our legal department without additional costs to unit owners.
